Time slots are no more than 20 minutes, therefore arriving on time for your session is very important. Each session will start at the time it was scheduled. Arriving late will shorten the length of your session.

Cancellation due to weather, fire or other casualty, act of God, act of terrorism, or other causes beyond the control of the parties, or due to illness of the ALYSHA NOEL PHOTOGRAPHY LLC is at the ALYSHA NOEL PHOTOGRAPHY'S discretion only.

​

Payment for the session is due in full at the time of booking to secure your slot. If cancellation happens 2 weeks before scheduled session (April 15th), ALYSHA NOEL PHOTOGRAPHY LLC will refund CLIENT half of their paid amount OR CLIENT can choose to use their paid amount as a credit towards a full custom session. There are no refunds given for limited edition session fee/s upon cancellation after the 2 week mark (April 15th), or due to no show. However, if the cancellation is within 24 hours, CLIENT may use the credit toward a full custom session, if booked within 2 months of the limited edition session date.

This Agreement qualifies as a model and property release for you, your pets, and your child(ren). The CLIENT signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons and property included in the portrait in this manner and shall indemnify and defend ALYSHA NOEL PHOTOGRAPHY LLC in the event of litigation arising out of such use.

​

If CLIENT chooses to book a full custom session and receives the limited edition session for free, they will still pay the limited edition session fee. Then when CLIENT goes to pay full custom session fee, the limited edition session fee they previously paid for will be taken off of the full custom session fee invoice. CLIENT understands that in order for this to happen, they are required to pay for the full custom session in full before 4/29/23.

ALYSHA NOEL PHOTOGRAPHY LLC is not responsible for any missing, damaged or altered belongings or clothing/material belonging to the CLIENT or anyone at the event. CLIENT is aware that for some photos CLIENT may or may not get dirty. It is ultimately the CLIENT's responsibility to make sure their dogs appearance is up to their standards.

ALYSHA NOEL PHOTOGRAPHY LLC will try her absolute hardest to capture exactly what CLIENT wants, but cannot promise that they all will be able to be done. Deliverable items and shots are contingent upon the client performing actions and cooperating with the ALYSHA NOEL PHOTOGRAPHY LLC. ALYSHA NOEL PHOTOGRAPHY LLC is not liable if the CLIENT’S neglect leads to a compromise of what has been agreed upon. (i.e. client not willing to listen to posing advice from photographer, resulting in them being displeased when viewing the photos afterward due to posing). ALYSHA NOEL PHOTOGRAPHY LLC shall not be responsible for photographs not taken as a result of the CLIENT’S failure to provide ALYSHA NOEL PHOTOGRAPHY LLC with information about the specific photos (i.e. photo was never taken of a grandmother due to client not providing photographer with the required knowledge).

Due to the format that limited edition sessions are run, no re-shoots will be allowed.

​

CLIENT understands that they will receive 5-10 edited images for limited edition sessions and that they cannot demand more after the session is done. 

​

CLIENT will receive either all of the hand edited high resolution digitals from their session or a select few. Along with the high resolution files,

​

CLIENT understands that high resolution digitals with printing rights DO NOT come with limited edition sessions. CLIENT will receive the social media digitals that match the 3 matted prints that come along with limited edition session. These are smaller in resolution (perfect for sharing online) and will have ALYSHA NOEL PHOTOGRAPHY'S logo placed tastefully on the images. CLIENT understands that they are to use the social media digital files for sharing online ONLY! High resolution digital files (without logo), along with printing rights, are available for purchase. CLIENT understands that the high resolution digitals (without logo) are for personal use only and CANNOT be shared online via social media, email, or any other online platform. 

 

ALYSHA NOEL PHOTOGRAPHY  LLC will let CLIENT know when everything is ready for delivery/pickup. ALYSHA NOEL PHOTOGRAPHY LLC can’t guarantee the amount of photos that will be delivered because each event is different. 

​

ALYSHA NOEL PHOTOGRAPHY  LLC works hard to take time to edit photos to their best ability. CLIENT understands that all images are final and will not be reshot at any time, unless under ALYSHA NOEL PHOTOGRAPHY LLC's approval. ALYSHA NOEL PHOTOGRAPHY LLC has their own style and specific way of shooting and editing photos to fit their brand. CLIENT understands that they have no authority over ALYSHA NOEL PHOTOGRAPHY LLC's editing style and cannot demand photos be edited to look a different way. Once photos are edited and uploaded to online viewing gallery, CLIENT may request ALYSHA NOEL PHOTOGRAPHY LLC to REtouch images (i.e. pimple removed) at an additional charge per photo. CLIENT understands that not all REtouching is possible (i.e. making someone appear thinner in photos).

Once the actual photo session is over, ALYSHA NOEL PHOTOGRAPHY LLC will be hard at work editing CLIENTS photos. Once ALYSHA NOEL PHOTOGRAPHY LLC is done editing, she will notify CLIENT and they can schedule a time slot for a complimentary Reveal and Ordering Party. CLIENT will be able to sit back and relax while viewing their beautiful photos. ALYSHA NOEL PHOTOGRAPHY LLC will show CLIENT what is available to purchase using their artwork credit and help walk CLIENT through the deciding process. CLIENT also understands that due to the nature of the printing process, once the order is placed, it is finalized and they cannot receive a refund or exchange a product for another product if they didn’t want what they originally ordered.

Credit included in limited edition session can only be used on wall art. Credit CAN NOT be used on “add on” items or to upgrade their print box that comes with the session. CLIENT also understands that this said artwork credit is only availalbe to use for three weeks after their reveal and ordering party. If CLIENT does not use their artwork credit within that three week timeframe, then they will forfeit their credit.

CLIENT understands that the prices for photo session packages, artwork collections, a la carte artwork, and add-on items are subject to change at any point. CLIENT cannot hold ALYSHA NOEL PHOTOGRAPHY liable to the original pricing showed to the CLIENT.

​

CLIENT understands that the 15% off of a wall art IS NOT applied to the wall art that is already included in the artwork collections. CLIENT understands that in order to receive the 15% off, they need to purchase 3 or more artwork pieces as a la carte.

​

CLIENT understands that orders are to be paid in full (unless a payment plan was put into place) as soon as CLIENT receives their invoice. ALYSHA NOEL PHOTOGRAPHY LLC will not put CLIENTS order into production until CLIENT pays the amount in full. CLIENT also understands that their order CANNOT be changed after submitting to ALYSHA NOEL PHOTOGRAPHY, even if she has not put the order in yet.

​

ALYSHA NOEL PHOTOGRAPHY LLC tries her hardest to make sure that everyone is able to receive beautiful artwork from their session without stress. Payment plans are available for added on artwork (NOT limited edition session fee) upon request. The typical payment plan is having the final order amount divided by 3. 1/3 of final order amount is to be paid every month. ALYSHA NOEL PHOTOGRAPHY LLC is willing to work out other payment plan options if the one stated above does not fit CLIENTS situation.

CLIENT agrees that unedited/RAW photos will not be shared for any reason by ALYSHA NOEL PHOTOGRAPHY LLC.

​

ALYSHA NOEL PHOTOGRAPHY LLC will inspect the artwork as soon as they are delivered and make sure they are perfect. ALYSHA NOEL PHOTOGRAPHY LLC will then contact CLIENT and let them know that their artwork is ready to be picked up. ALYSHA NOEL PHOTOGRAPHY LLC may choose deliver the artwork to the CLIENTS home or CLIENT can pick up the artwork at a certain location. It is recommended that the CLIENT pick up artwork within the week that they arrive to avoid any delays or issues.

​

After twelve (12) months, all images will be purged from ALYSHA NOEL PHOTOGRAPHY LLC's hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. ALYSHA NOEL PHOTOGRAPHY LLC is not responsible for loss or damage to the digital files due to circumstances beyond her control. If something happens to CLIENT’S hard-drive AND flash drive and he/she loses all digital images within the 12 month time period, then contact the ALYSHA NOEL PHOTOGRAPHY LLC.

ALYSHA NOEL PHOTOGRAPHY LLC is not responsible for the damage of portraits after delivery to CLIENT, including damage caused during transit by US mail, UPS, or FedEx. CLIENT assumes all responsibility for the safety of all portraits upon receipt.

​

ALYSHA NOEL PHOTOGRAPHY LLC is not responsible for any injuries inflicted upon any participating parties. CLIENT(S) will be responsible for their children, pets, family members, and for themselves and release photographer from any claims against their person or their business. If there is an equipment malfunction where all photos are lost after the session (non event), ALYSHA NOEL PHOTOGRAPHY LLC will redo the session at an agreed time for no charge. If there is an equipment malfunction where all photos are lost after the session for an event, then the ALYSHA NOEL PHOTOGRAPHY LLC will refund the what he/she has already paid the photographer. If ALYSHA NOEL PHOTOGRAPHY LLC cannot make it to the event (non session) for any reason of her non-performance caused by any force or similar circumstances, illness, weather, an accident, equipment malfunction or any cause beyond their control, then the photographer will refund the amount paid back to the client. PHOTOGRAPHER reserves the right to reschedule a session (non event) due to illness, weather, accident, equipment malfunction, or other circumstances beyond their control. In any event, the limit of PHOTOGRAPHER’S liability shall not exceed the contract price stated herein.

CLIENT(s) further understand that ALYSHA NOEL PHOTOGRAPHY LLC complies with all health and safety laws, directives, and rules and regulations. CLIENT(s) expressly agree(s) that during the [event/session] CLIENT(s) and CLIENT(s)’ agents shall not carry weapons or firearms, be exposed to severe illness, or request ALYSHA NOEL PHOTOGRAPHY LLC to do anything illegal or unsafe. Further, ALYSHA NOEL PHOTOGRAPHY LLC will not provide services in any location or area deemed to be unsafe in its sole discretion, including, but not limited to, areas affected by communicable diseases, quarantined areas, or other similar occurrences. Under any of these circumstances, ALYSHA NOEL PHOTOGRAPHY LLC reserves the right to end service coverage immediately and/or leave the [event/session]. ALYSHA NOEL PHOTOGRAPHY LLC shall be entitled to retain all monies paid and CLIENT(s) agree to relieve and hold ALYSHA NOEL PHOTOGRAPHY  LLC harmless as a result of incomplete event coverage, or for a lapse in the quality of the ALYSHA NOEL PHOTOGRAPHY LLC's work.

The Owner represents that his/her Pet has not bitten or shown any aggressive or threatening behavior toward any person, child or animal. The Owner understands that he/she is solely responsible for any harm caused by his/her Pet, to any person (including photographer), other Pets, or property, while the Owner's Pet is at the shoot. If your dog should bite or harm another dog or person, or spread any illnesses to other dogs, the owner will be responsible for any burdens that occurred to the other party. ALYSHA NOEL PHOTOGRAPHY LLC will not be responsible for any injuries that are out of control of our staff that your dog encounters. The Owner understands that Pets when in groups, can accidentally injure each other while playing or swimming. Minor cuts, scrapes, bite wounds and bruises are a possible and not unexpected result of participation in group activities.

​

It is understood that no other photographer, amateur or professional, shall be allowed to photograph at the session/event near ALYSHA NOEL PHOTOGRAPHY LLC while she is working due to reasons of the photographer delivering the quality of images as expected. Any breach of this agreement can constitute a reason for non-completion of the job with no liability to ALYSHA NOEL PHOTOGRAPHY LLC

TAX: Sadly, the state of Pennsylvania requires Photographers to charge sales tax on services (session fees) as well as the usual sales tax for products. CLIENT understands that sales tax for the session fee will be added to their invoice and will be paid along with the owed amount of the session.

​

The Federal Copyright Law protects copyright. ALYSHA NOEL PHOTOGRAPHY LLC shall retain ownership of the copyright to all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submission and use, advertising, or for display within or on the Photographer’s website and/or studio in all media forms now known or hereafter devised. ALYSHA NOEL PHOTOGRAPHY LLC reserves the right to sell images for stock or commercial use, this does NOT apply to any image with a human adult or child. Images containing human subjects will not be used for STOCK or COMMERCIAL use without your written permission. It is illegal to scan, copy, or reproduce work in any manner and is punishable by law with fines starting at $150,000. ALYSHA NOEL PHOTOGRAPHY LLC goes to great lengths to provide top-quality, beautiful images that you are proud to display. Copying and scanning these images greatly reduce their beauty and quality.
